Terms of sale

These terms are not final. The trading entity, ABN and registered address are still being settled, and a set of terms that does not name the business behind it is not much use to either side. What is written here is what is intended, and it will be confirmed before the shop takes real money.

Who you are buying from

Ausax, on the Sunshine Coast, Queensland, Australia.

Everything is made or refurbished by one person. Where something is on consignment — sold on behalf of its owner — the listing says so, and the same terms apply.

Prices and currency

Prices are in Australian dollars and include GST where it applies. You may see prices converted into another currency; that is a guide, and the amount charged is always the Australian dollar figure. Your bank does the conversion at its own rate.

Orders sent outside Australia are GST-free, and the GST is removed at the checkout rather than kept.

Delivery, duties and taxes

Postage is quoted separately and depends on where the parcel is going and what is in it. Everything is sent tracked and insured.

For orders outside Australia, import duty and any tax charged where you live are payable by you, usually collected by the carrier before delivery, along with their handling fee. These are not included in the price and we cannot tell you what they will be — they depend on your country's rules on the day the parcel arrives. The checkout says so again before you pay.

If a parcel is refused at the border or returned unclaimed, the cost of getting it back is deducted from any refund.

Your rights if something is wrong

Australian Consumer Law guarantees apply and cannot be excluded. Goods must be of acceptable quality, match their description and be fit for their purpose. If something fails to meet a consumer guarantee you are entitled to a repair, replacement or refund — a refund for a major failure, and compensation for any other reasonably foreseeable loss. Nothing on this page limits that.

These rights are yours wherever you are. If you are in the EU or the UK your own consumer law also applies, and you get whichever is better for you.

In practice: if a piece arrives damaged, or is not what was described, say so and it will be sorted out. Photographs help.

Changing your mind

If you are in the EU or the UK, you have a statutory right to cancel within fourteen days of receiving the goods, without giving a reason, and a further fourteen days to send them back. You pay the return postage. This is your right in law, not something granted here.

That right does not apply to goods made to your own specification — a commission, or a mouthpiece refaced to measurements you gave. Those are made for you and cannot be sold to anybody else. It does apply to anything bought as-is from the shop page, because that piece already existed.

Anywhere else, including Australia, there is no legal right to return something simply because you changed your mind, and none is offered on custom work. For an item bought as-is from the shop, get in touch: if it comes back unused and as it left, in its original packaging, within fourteen days, it will normally be refunded less postage. That is a courtesy rather than a policy, and it is worth asking first.

Reeds, and anything else that goes in your mouth, cannot be returned once the packaging is opened, for reasons that need no explaining.

Commissions and made-to-order work

A commission starts with a proforma invoice for a deposit. Work begins when that is paid, and the deposit is not refundable once it has — because it buys bench time and material that cannot be given back. The balance is invoiced when the piece is finished.

Lead times are honest estimates rather than promises. If something is going to be late you will hear about it before the date, not after.

Payment

Shop orders are paid by card or Australian bank debit through Stripe, on their own hosted page. Card details never reach this website.

Wholesale and commission work is paid by bank transfer against a proforma invoice. A proforma invoice is a request for payment, not a tax invoice; the tax invoice follows the supply.

Consigned items

Some pieces are sold on behalf of their owner. The listing says so. You buy from us, the same terms apply, and the consumer guarantees above are ours to honour rather than the owner's.

Law

These terms are governed by the law of Queensland, Australia. If you are a consumer in the EU or the UK, this does not take away the protection of the mandatory consumer law of the country you live in, or your right to bring a claim there.
